• Subject of the issue: Another amendment to the Act on Waste is being prepared
    The Ministry of Climate presented a draft of another amendment to the act on waste. The project involves the verification of data from the Waste Database (BDO) with the data of the National Tax Administration obtained from the SAF-T system. The introduction of this functionality is to reduce the shadow economy in waste management and tighten the system, which should also result in increased revenues to the state budget from VAT, CIT and marshal fees.

    The Ministry of Climate presented a draft of a new regulation on the template for the report on food waste and the template for the collective report on food waste, which is to enter into force on January 1, 2021.

  • Packaging waste from hazardous substances - how to distinguish between them
    Pursuant to the Waste Act, a waste producer is responsible for their correct classification, i.e. determination of the code on the basis of the waste catalog. According to the waste catalog, the packaging of hazardous substances is classified as 15 01 10 * (packaging containing residues of hazardous substances or contaminated with them). In the case of packaging waste from hazardous substances, the classification can be troublesome, because not every hazardous substance (contained in the packaging) will result in the classification of the waste as a packaging for a hazardous substance.
  • Waste transportation permit and BDO
    Question: Please let me know if in order to be entered in the table of transporters in Annex VII, it is necessary to appear in the BDO as a transporting entity (i.e. have a permit to transport waste)? Is GDOS, when issuing Annex VII, can / should check whether the entity that is to transport the waste abroad is listed in the BDO as authorized to transport, or is it an unnecessary mixing of competences?
  • Equipment installed in the device - is it subject to the provisions of the WEEE Act
    Question: Is equipment purchased abroad, and in Poland fitted to buses, subject to the Waste Electrical and Electronic Equipment Act? For example monitors, loudspeakers, ticket machines? Do we have any obligations in this connection?
