The obligation to maintain sobriety in the place and time of work is one of the basic obligations guaranteeing an appropriate level of safety. For many years, the process of verifying the sobriety of employees was problematic in practice - due to the lack of direct regulations under labor law. The Act of December 1, 2022 amending the Labor Code and some other acts contains regulations allowing for the possibility of conducting sobriety tests at the level of the workplace.
